Kullanım Koşulları

Bu koşullar, sizinle Türkiye'de yerleşik bireysel geliştirici Salih Kamaş ("Logifyix", "biz") arasında, Gordia mobil uygulaması ve logifyix.com sitesi (birlikte "Hizmet") için yapılmış bir sözleşmedir. Hizmet'i kullanarak bu koşulları kabul etmiş olursunuz. Kabul etmiyorsanız lütfen Hizmet'i kullanmayın.

01 Kimler kullanabilir

En az 13 yaşında olmalısınız. Avrupa Ekonomik Alanı'ndaysanız, ülkeniz daha düşük bir yaş belirlememişse en az 16 yaşında olmalısınız. Hizmet'i kullanarak bu şartı sağladığınızı beyan edersiniz.

02 Hesabınız

Gordia ilk açılışta sizin için anonim bir hesap oluşturur. İsterseniz, cihazınızı kaybettiğinizde ilerlemenizin kaybolmaması için bir Google hesabı bağlayabilirsiniz.

Bağlanmamış bir hesap yalnızca o cihazda vardır. Uygulamayı silmek, cihazı sıfırlamak veya çıkış yapmak hesabı ve tüm ilerlemeyi kalıcı olarak yok eder. Geri getiremeyiz. Bu, kişisel verilerinizi toplamamamızın bir sonucudur; bir arıza değildir.

Hesabınız altında olan bitenden siz sorumlusunuz. Hesabınızı paylaşmayın, başkasının hesabını kullanmayın.

03 Brain Coin

Brain Coin, oyun içi sanal bir öğedir. Bu bölümü dikkatle okuyun.

Brain Coin'in parasal değeri yoktur. Para değildir, para birimi değildir, ödeme aracı değildir, mülkiyet konusu değildir.
Satın alınamaz. Hizmet'te uygulama içi satın alma yoktur. Coin yalnızca oynayarak kazanılır.
Hizmet içinde veya dışında nakde çevrilemez, satılamaz, devredilemez, hediye edilemez ve değeri olan hiçbir şeyle takas edilemez.
İade edilmez.
Oyun dengesi gereği coin'in neye mal olduğunu, ne kazandırdığını ve nasıl verildiğini dilediğimiz zaman değiştirebiliriz.
Coin hesabınıza bağlıdır ve hesabınızla birlikte yok olur. Hesabınızı silerseniz veya 5. madde uyarınca hesabınızı kapatırsak bakiyeniz gider ve karşılığı ödenmez.

Yarışta coin yatırmak bir oyun mekaniğidir, kumar değildir: içeri gerçek para girmez, dışarı değeri olan hiçbir şey çıkmaz.

04 Adil oyun

Oyunları oynanması gerektiği gibi oynayın. Şunları yapamazsınız:

bot, betik, otomasyon, emülatör veya değiştirilmiş istemci kullanmak;
coin, puan, başarım veya liderlik sıralaması elde etmek için hatalardan yararlanmak ya da fark ettikten sonra bir açığı kullanmaya devam etmek;
Hizmet'e, sunucularına veya ağına müdahale etmek, size ait olmayan verilere erişmeye çalışmak;
kanunun açıkça izin verdiği hâller dışında Hizmet'i tersine mühendislikle çözmek;
saldırgan, yanıltıcı, başkasının yerine geçen veya üçüncü kişilerin haklarını ihlal eden bir görünen ad seçmek;
diğer oyunculara taciz veya kötü muamelede bulunmak.

Bulmaca cevapları sunucularımızda tutulur ve zamanı gelince açılır. Yayınlanmamış bulmacalara veya cevaplara ulaşmaya çalışmak bu koşulların ihlalidir.

05 Askıya alma ve sona erdirme

Bu koşulları ihlal ederseniz; ihlalle elde edilen coin, puan, başarım ve liderlik kayıtlarını kaldırabilir, hesabınızı askıya alabilir veya kalıcı olarak kapatabiliriz. Makul olduğu ölçüde sebebini size bildiririz.

Hizmet'i kullanmayı istediğiniz zaman bırakabilir ve Ayarlar → Hesabı sil yolundan hesabınızı silebilirsiniz.

06 Hizmet değişebilir

Gordia yaşayan bir hizmettir. Oyun, bulmaca, özellik ve kuralları ekleyebilir, değiştirebilir veya kaldırabilir; oyun ekonomisini yeniden dengeleyebiliriz. Hizmet'i askıya alabilir veya sonlandırabiliriz. Bu koşullarda hiçbir oyunun, özelliğin veya içeriğin kullanılabilir kalacağına dair bir garanti yoktur.

Hizmet'in kesintisiz veya hatasız olacağını garanti etmiyoruz. Günlük bulmacalar, oynadığınız anda cihazınızın çalışan bir bağlantısı olmasına bağlıdır.

07 Fikrî mülkiyet

Hizmet — yazılımı, tasarımı, oyun kuralları, bulmaca setleri, görselleri, metinleri ve Gordia ve Logifyix adları ile logoları dâhil — bize veya lisans verenlerimize aittir ve fikrî mülkiyet mevzuatıyla korunur. Size, Hizmet'i kendi eğlenceniz için kullanmanıza yönelik kişisel, münhasır olmayan, devredilemez ve geri alınabilir bir lisans verilir. Hizmet'i kopyalayamaz, dağıtamaz, yayımlayamaz, satamaz veya ondan türev eser üretemezsiniz.

Kendi sonuçlarınızı paylaşmanız — skor kartı, tamamlanmış bir tahta — açıkça serbesttir ve teşvik edilir.

08 Sorumluluğun sınırlandırılması

Hizmet "olduğu gibi" sunulur. Kanunun izin verdiği azami ölçüde, satılabilirlik, belirli bir amaca uygunluk ve ihlal etmeme konusundaki zımni garantileri hariç tutarız.

Dolaylı veya netice kabilinden zararlardan; sanal öğelerin, ilerlemenin veya verilerin kaybından, ağır kusurumuz veya kastımızdan kaynaklanan hâller dışında sorumlu değiliz.

Bu koşullardaki hiçbir hüküm, tüketici mevzuatından doğan haklarınız dâhil olmak üzere kanunen sınırlandırılamayan sorumluluğu sınırlamaz.

09 Gizlilik

Kişisel verileri nasıl işlediğimiz Gizlilik Politikası'nda açıklanmıştır ve bu koşulların ayrılmaz bir parçasıdır.

10 Koşullardaki değişiklikler

Bu koşulları güncelleyebiliriz. En üstteki tarih son değişikliği gösterir. Esaslı değişikliklerde, yürürlüğe girmeden önce uygulama içinde bilgilendiririz. Sonrasında Hizmet'i kullanmaya devam etmeniz yeni koşulları kabul ettiğiniz anlamına gelir.

11 Uygulanacak hukuk

Bu koşullar Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda İzmir Mahkemeleri ve İcra Daireleri yetkilidir.

Bu hüküm tüketici haklarınızı sınırlamaz. Tüketici sıfatıyla hareket ediyorsanız, tüketici mevzuatı uyarınca kendi yerleşim yerinizdeki tüketici mahkemelerine ve tüketici hakem heyetlerine başvurma hakkınız saklıdır. Avrupa Birliği'nde yerleşik bir tüketiciyseniz bu hüküm, kendi ülkenizin emredici hukukunun sağladığı korumadan sizi yoksun bırakmaz.

Terms of Use

These terms are an agreement between you and Salih Kamaş, an individual developer established in Türkiye ("Logifyix", "we", "us"), covering the Gordia mobile application and logifyix.com (together, the "Service"). By using the Service you accept these terms. If you do not accept them, please do not use the Service.

01 Who may use Gordia

You must be at least 13 years old. In the European Economic Area you must be at least 16, unless your country sets a lower age. By using the Service you confirm that you meet this requirement.

02 Your account

Gordia creates an anonymous account for you on first launch. You may optionally link a Google account so that your progress survives losing your device.

An account that is not linked exists only on that device. Deleting the app, resetting the device or signing out destroys it permanently, along with all progress. We cannot recover it. This is a consequence of not collecting your personal data, not a defect.

You are responsible for what happens under your account. Do not share it, and do not use someone else's.

03 Brain Coins

Brain Coins are a virtual in-game item. Read this section carefully.

Brain Coins have no monetary value. They are not money, not a currency, not a payment instrument and not property.
They cannot be purchased. The Service contains no in-app purchases. Coins are earned only by playing.
They cannot be cashed out, sold, transferred, gifted or exchanged for money or anything of value, inside or outside the Service.
They are non-refundable.
We may change what coins cost, what they earn and how they are awarded, at any time, as part of balancing the game.
Coins are tied to your account and cease to exist with it. If you delete your account, or if we close it under section 5, your balance is gone and is not compensated.

Wagering coins on a race is a game mechanic, not gambling: no real money enters, and nothing of value can leave.

04 Fair play

Play the games as they are meant to be played. You may not:

use bots, scripts, automation, emulators or modified clients;
exploit bugs to obtain coins, scores, achievements or leaderboard positions, or continue using an exploit after noticing it;
interfere with the Service, its servers or its network, or attempt to access data that is not yours;
reverse engineer the Service, except where the law expressly permits it;
choose a display name that is offensive, deceptive, impersonates someone else, or infringes another party's rights;
harass or abuse other players.

Puzzle answers are held on our servers and released on schedule. Attempting to obtain unreleased puzzles or answers is a breach of these terms.

05 Suspension and termination

If you breach these terms we may remove coins, scores, achievements or leaderboard entries obtained in breach, suspend your account, or close it permanently. Where it is reasonable to do so, we will tell you why.

You may stop using the Service and delete your account at any time through Settings → Delete account.

06 The Service may change

Gordia is a live service. We may add, change or remove games, puzzles, features and rules, and we may adjust the game economy. We may also suspend or discontinue the Service. Nothing in these terms guarantees that any particular game, feature or piece of content will remain available.

We do not guarantee that the Service will be uninterrupted or error-free. Daily puzzles depend on your device having a working connection at the time you play.

07 Intellectual property

The Service, including its software, design, game rules, puzzle sets, artwork, text and the Gordia and Logifyix names and logos, belongs to us or our licensors and is protected by intellectual property law. You get a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own entertainment. You may not copy, distribute, publish, sell or create derivative works from it.

Sharing your own results — a score card, a completed grid — is expressly permitted and encouraged.

08 Disclaimer and liability

The Service is provided "as is". To the fullest extent permitted by law, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We are not liable for indirect or consequential loss, or for loss of virtual items, progress or data, except where such loss results from our own gross negligence or wilful misconduct.

Nothing in these terms limits liability that cannot be limited by law, including your statutory consumer rights.

09 Privacy

Our handling of personal data is described in the Privacy Policy, which forms part of these terms.

10 Changes to these terms

We may update these terms. The date at the top shows when they last changed. For material changes we will notify you in the app before they take effect. Continuing to use the Service after that means you accept the new terms.

11 Governing law

These terms are governed by the laws of the Republic of Türkiye. Disputes are subject to the courts and enforcement offices of İzmir, Türkiye.

This does not limit your consumer rights. If you are acting as a consumer, Turkish consumer law preserves your right to apply to the consumer courts and consumer arbitration committees where you live. If you are a consumer resident in the European Union, this clause does not deprive you of the protection of the mandatory law of your own country.
